This Software Product License ("SPL") is a legal agreement between you (the "user") and ID express Oy for the product identified above, which includes "online" or electronic documentation and may include computer software ("SOFTWARE PRODUCT"), and associated media and printed materials. By installing, copying, or otherwise using the SOFTWARE PRODUCT, the user agrees to be bound by the terms of this SPL. If the user does not agree to the terms of the SPL, they are not authorized to use the SOFTWARE PRODUCT.
SOFTWARE PRODUCT
The SOFTWARE PRODUCT represents the final, machine readable version of the software. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual and property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE. This SPL grants you the following rights:
• SOFTWARE PRODUCT installation and Use. For each Single-User license you have purchase, you may install and use one copy of the SOFTWARE PRODUCT, on one single computer at a time. If you wish to use the software on an additional computer, it must be removed from the first computer, or a second license must be purchased.
• If you have purchased a site license, you may install and use an unlimited number of copies of the SOFTWARE PRODUCT, provided that all computers on which it is installed are owned or operated by the holder of the site license, and they are all located (or usually located) within the same building or campus.
• If you have purchased a world license, you may install and use an unlimited number of copies of the SOFTWARE PRODUCT, provided that all computers on which it is installed are owned or operated by the holder of the world license.
• You may make as many copies of the software as are required for backup purposes, so long as these copies are only stored for backup and are not actually executed.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
• You must maintain all copyright notices on all copies of the SOFTWARE PRODUCT.
• Termination. Without prejudice to any other rights, ID express Oy may terminate this SPL if you fail to comply with the terms and conditions of this SPL. In such event, you must destroy all copies of the SOFTWARE PRODUCT.
• You may not alter, reverse engineer, decompile, or otherwise modify the SOFTWARE PRODUCT.
3. COPYRIGHT. All title and copyright in and to the SOFTWARE PRODUCT and any copies thereof are owned by ID express Oy.
4. DISTRIBUTION. You may distribute the SOFTWARE PRODUCT under the following conditions.
• The SOFTWARE PRODUCT installer must be distributed along with any accompanying documents. You may not distribute the individual items created by the installer.
• You may not distribute registered versions of the SIM express application, except where you have purchased a license that allows you to do so (such as a Site or World license).
• It is distributed free of charge, except for media costs where necessary.
• It may not be distributed with other programs or products that are sold for profit without the consent of ID express Oy.
• If you wish to include the SOFTWARE PRODUCT in any commercial shareware compilation (such as CD-ROMs or Books) you must first inform ID express Oy of your intention. It is also preferred, though not required, that you either send a free copy of the compilation in question to ID express Oy, or provide ID express Oy with the opportunity to purchase the item at a discounted price.
NO WARRANTIES. ID express Oy expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is provided "as is" without any warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non infringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with the user.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall ID express Oy be liable for any damages whatsoever (including, without limitation, damage for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this ID express Oy product, even if ID express Oy has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In no case shall ID express Oy's liability amount to more then nineteen ($19) dollars.
